I'd say this.If the measure was physical maturity we'd be lowering the age of consent because puberty is hitting kids earlier.
Of course that's undesirable on so many levels... the point is mental competence, and given he doesn't even grasp the basic biology I would say his mental age is probably less than half of 16.

I get the impression that the other bloke is most likely the reason that social services brought this case, more to stop that man who may well have been preying on a vulnerable person, albeit entirely legally, than to stop a person with a low IQ from having sex. Tricky situation.
