Car left to a Garage - damaged
Discussion
Have left my car to local Mercedes garage for them to sell it on my behalf.
I left an immaculate car, clean with no single scratch and was promided that the car will be kept in their warehouse.
The car didn't sell after 6 weeks so I came to pick it up and found my car so dirty it was brown (usually its blue), the passenger windows was broken and there was scratches on the front bumper and wheel arches. In addition the battery was flat. Apparently the car was left parked near a house destruction plan not in the warehouse.
When a brought the car we inspected it all around but nothing was mad ein writing.
The only thing I was told is your insurance will pay for the glass but there is an excess, left the car there until Monday but don't see what I can do to get all these damages fixed before I collect it.

If you had nothing in writing detailing the location of any existing damage on the car - no matter how minor - and signed by both of you then you are going to find it difficult to prove the damage wasn't there when you gave them the car. Which is what they will no doubt claim.
What do you actually have in writing regarding this matter?
ETA as its Saturday I think your chances of getting anything repaired before Monday collection are nil.

Main Mercedes Dealer or an independent specialist or some local guy who repairs and flogs old smokers bought from auctions? If main dealer then get on to Mercedes themselves if the garage will not pay for repairs.

Did you take pictures before you accepted the car back?I left an immaculate car, clean with no single scratch and was promided that the car will be kept in their warehouse.

I have not taken any pictures because I was supposed to collect the car that day and was not informed of any damage or issues, I think they just dumped the car in the street without event trying to sell it.
I think that I should try to take a tape recorder on Monday and confront the garage manager, I will have evidence as he may say things....
I don't want to take the car back until they fix it as otherwise if the car leave their garage I am really losing all my rights.
Is any of you ever claimed money back in court?
I have an email that I wrote after I left the car where I remind them that the car need to be kept in the warehouse and that it was damage free (no reply to this email bust it still something written).
By the way my car is a Mercedes S430 so any repair are very expensive indeed.

Not worth anything. I think that I should try to take a tape recorder on Monday and confront the garage manager, I will have evidence as he may say things....

As said before, what written agreements/contract do you have with the garage?
The window was cracked, luckily the car has double glazing so the interior was not exposed. This garage is not a Mercedes dealer, it a Mercedes specialist.
The car was supposed to be left in their warehouse and the would show it to potential buyer by appointment, this is what we arranged.

Ah, that makes sense now.The car was supposed to be left in their warehouse and the would show it to potential buyer by appointment, this is what we arranged.
Push hard for car to be put right but with no contract of SOR, you could be in for a difficult time.
Yes I was stupid to think that I could trust this garage as they have a good reputation so I was a bit naive.
They left the car in the street and in front a house was about to be demolished (maybe they didn't know that demolition will start), the damages might be worst as there may be multiple stones impact all over the bodywork - couldn't see it yesterday as it was fully covered with a thick dust, have only spotted the damage in the front and a broken piece inside the car.
I have no written agreement but it is clear that I wanted the car kept in their warehouse not outside and this is what they promised.
I spent nearly 2k fixing this car with them before asking them to sell it on my behalf.
