Hi guys,

In a bit of a sticky situation,

My girlfriend and I are due to move into an apartment around the week of the 2nd August, After speaking to the letting agency in charge of my shared house they say "We need one months notice from when your rent is due - so we'd need to know by the last day of the month before you wanted to leave".

So does this mean I can't leave the property until the 31st August?!

May be worth adding that my tenancy is an AST but I didn't renew the contract.

I moved in in 2005, and the landlord signed the place over to a letting agency in 2009-ish.

I didn't sign a new contract with the letting agency.

No. You can leave the property whenever you want. But if you have to give a months notice from the day of rent and that is the last day of the month, then you will be eligible to pay the months rental charge for August (if you didn't hand your notice in at the end of June).

bks.

This would've been fine but people previously in the property have left at short notice and the landlord has been fine with it, The LA aren't as forgiving.

So basically I am going to lose a couple of hundred quid?

You can certainly leave it, but sounds like you have to pay the full rent for July and August. But check with the agents.

That they would have to go without any income from the property were you to stop paying rent straight away and it remained empty. That's the joy of letting agents. Don't want to sound like a dick but I'd guess it's detailed in your tenancy agreement, which you should have a copy of.

The day in the month your rent is due, is usually the day in the month your tenancy started. So if we take that day to be the 3rd, then one months Notice would be up to and including 2nd day of the proceeding month, i.e. 3rd. August one months Notice, termination of the tenancy being 2nd. September. As others have stated you can vacate earlier, but you will still be responsible for rent up to the end of the tenancy.
