Losing Control - Question

Fellow Owners,
Need some help here. I was involved in a car accident in December, which involved me losing control of my Tiv due to someone pulling out on me. I tried to avoid them and surprise surprise, lost control of my Griff and went into a sideways slide which ended in me hitting someone else.
Now although the accident occurred due to someone else pulling out on me ( they drove off by the way, no record of them ) the police are charging me with dangerous driving.
Now, I want to prove that TVRs ( a Griff in my case ) are easy to lose control of, in situations like this even though the road was dry. I was doing 70mph at the time.
Does anyone have a road test / statement or the like that they could get to me that states this?
BTW, the car's getting fixed as we speak and will be back on the road at the end of March.

Would that help? Surely the prosecution will just argue that you should've been approaching any junction at a speed at which you could control your car if someone pulled out on you? I'm not sure "but it's a very difficult car to drive, Your Honour" will help much. It might even get you into hotter water if you admit you're driving a car you can't always control.

So you have a prang, no one hurt and BIB want to do you for DD. Been two serious 'accidents' repoprted on telly this week both involving pedestrian fatalities sadly. BIB did not prosicute either for DD but the lesser charge of driving without due care attention. If they persist get yourself a good legal firm.

Why does everyone nowadays want to blame someone else? Unless I've misunderstood it, you hit the anchors and tried to steer, and lost it. Unless you choose to drive an ABS equipped car (and you chose a well known non-ABS barnd) then you can't brake and steer. Don't matter what it is, TVR or anything else; if you screw up on brakes and/or steering you can lose it. Why not put it all behind you and do a few track days or a driver training session so you can 'catch it' when it all goes wrong the next time?

It was a three lane carriageway. I was in the middle, and this car swerved, with no indication, in front of me from the inside lane. I swerved to avoid them, and in doing so, the tail of the Tiv snapped out, and I went into a slide.
Surely, I could say, if this was a saloon it might not have happened, but due to the nature of the car, they easier to lose control of in situations like this and therefore I could have been doing 50 and still lose control.

Ah. I see. One of those! This happens so often nowadays it's ridiculous.
Do you have any witnesses to this other car pulling out in front of you? I think getting witnesses to testify to someone else's negligence would be your best bet - I still think "but my car is very difficult to drive" could land you in even more trouble. The prosecution will surely argue that if you know your car can be unpredictable, you shouldn't be driving it and so the DD charge will stand.
I can't see how proving a Griff is tail-happy will place you in a positive light. All it'll say to the Man in Charge is that you can't control your own car. Doesn't sound good.

I would argue that the action you took was the lesser of two evils luckily, if you had the hit the first car it WOULD have been a serious accident. You instinctively chose the alternative which led to a mishap.
I don't see why you should be done according to the info you have provided.
Go and have a chat with your nearest traffic police dept, they are often very helpful in situations like this.
PS I had a similar event about 10 years, a guy pulled out on me at some crossroads. I would have T boned him at 60mph, instead I steered away & hit the grass bank. Totalled my car. The other guy admitted his mistake luckily.

Another car caused you to HAVE TO Take a very severe avoidance action, which while you avoided that accident, you were unable to avoid hitting another car.
DON'T blame the car.
imagine circumstances if you were on a bike, or a big 4x4, or in fact any other car.
Arguably a tVR (or any other sports car) has more grip, better steering response, lightness that actually helped you in avoiding, what might have been a bigger accident.
WHO is to say what might have been.
How do you know if you had tried the exact same avoidance manoeveur in any other vehicle, the result would have been better, worse, the same?

I don't want to give you more worry but I was convicted of Dangerous Driving back in 98. There was no incident, just very high speed.
CPS took stopping distances from the highway code and worked out I couldn't have stopped if someone pulled out of a turning I was passing. These stopping distances are OUT OF DATE. Probably done using a car with drum brakes all round and 125 wide tyres.
The car I was travaling in was a "performance car" and we all know it stops quicker than the highway code figures. Still, I was convicted, minimum ban of 1 year and 6 week inside!!
They do not take the type of vehicle into account.
I'm so sorry if it goes to this but it seems as though you have a fight on your hands.
My case went on for just over a year.
