I strongly beleve that we need a USA style Castle Doctrine (casle law) in this country. To many cases like this happening. Good new for the guy.

Good post. This went beyond self defence or defence of property but as you say, had they believed the courts would have delt appropriately with the offender maybe they would have contented themselves with giving him a slap and detaining him. His bro remains inside, albeit with a reduced sentence.

I believe we should be able to use "Reasonable Force" to defend our home and families from criminals, especially when they've tied up the family, as in this case.

The legal difficulty with this is defining "Reasonable Force."

It is my opinion that this chap went too far, but only by a bit.

In his situation, with adrenaline pumping and your family terrorised, I'm not sure I'd be able to stop until they stopped moving.

I don't condone his actions, but in his situation, I suspect I would do the same.

Great news. Hopefully next time he knocks a burglar for six it will be in the confines of his own homehehe

IIRC one of them escaped during the actual robbery and got reinforcements and then they barrered the guy. So it wasn't like he was robbed, the guy got away and then they went looking for him.

Out of interest, do burglars used reasonable force when obtaining goods illegally from our homes? (Reasonable being removing nothing as removing anything from my home without my permission is not reasonable.)

confused Relevance? It's not reasonable, so the burglars (should) get prosecuted.

The article I read said that his son fled upstairs, two of the attackers pursued him, Munir Hussain then turned on the one attacker that was left. That attacker then fled, Hussain gave chase... then it all goes a bit murky and the articles simply state Hussain, along with his brother and two others cornered the guy in a nearby garden and proceeded to beat the st out of him.

But I think his brother (the guy who is still in jail) escaped and came back with some mates.

Maybe so, but I (or anyone else) can't go and carry out vigilante justice against those who've done us wrong so I don't see what makes it any more acceptable for him to do so. As much as we might like to stove in the skulls of lowlife scumbags... we just can't.

Of course it's unreasonable for a burglar to burgle you which is why if he does and gets caught he gets prosecuted. If the burglar uses violence when burgling you I believe the charge would be aggravated burglary for which the penalty is considerably higher. Everything is proportionate. It's unreasonable to burgle therefore burglars get arrested, it's reasonable to protect yourself and your property but if you chase a bloke down the street and kick him half to death that's unreasonable.

Doesn't change what's reasonable or not. It's very frustrating that we perceive burglars etc get off lightly if caught at all, but that doesn't make it reasonable to use excessive force against them. Remember that reasonable force can include enough force to kill someone, depending on the situation.
