It seems not. Would this case have ever got to an American court?

The guys went too far.
He chased the guy, teamed up with a brother down the road, tooled up with hocky sticks, baseball bats etc and then jumped the guy when he was no longer a danger to his family. If they had called the cops and held him down, non of this would have happened.
If he had hit the guy with the bat inside his house whilst the burglar was holding his knife, non of this would have happened, even if his injuries were the same,

I think the issue is that they weren't defending the house, they were taking revenge.

the brothers chased and caught one, Walid Salem, a criminal with more than 50 previous convictions. He was then subjected to what Judge John Reddihough described as a "dreadful, violent attack" by the Hussain brothers.
Salem was left with a permanent brain injury after he was struck with a cricket bat so hard that it broke into three pieces. The revenge attack was self-defence that went too far, Reading crown court was told.

Completely disagree - I would have battered anyone who threatened my wife and children to within an inch of their lives, in my house or down the road.
And I'd do it knowing full well what the consequences could be.
The scumbags made a concious decision to go into that house and then they terrorised the family. Instantly their rights go completely out of the window and are responsible for everything they get.
You're looking at it the wrong way round.

Justice if you ask me.
If someone came into my house wielding weapons and masked, tied up my family and threatened me in my own home I would vow revenge. I wouldn't have an ounce of faith in the law dealing with such scum that is for sure.
The guy who took a kicking was a serial criminal hence I struggle to sympathise with him just because he has finally been administered some real justice by his victims...
Seriously, whoever suggests collaring him and just calling the cops is a buffoon. The guy has 50 convictions for the same thing. All he'll get is another slap on the wrist and he'd be out the next night subjecting someone elses family, maybe yours, to a similar experience....

If you are prepared to enter someones house, armed and happy to use that armament, you have to be ready to take the consequences of your actions.
In this case, a right good pasting.
Sorry, if he hadnt have broken the law in the first place, none of it would have happened.
If someone broke into mine, there would be a gunshot.
Plain and simple.

I'm not saying I agree or disagree with what they did to the guy. Was just stating why I think the courts gave them the sentence that they did.I think that the fairest way out for all parties was to have had a suspended sentance for the Hussains as it is highly unlikely that the same situation will hapen again but the Salem guy should still go down. Hopefully he has been beaten hard enough that he can't commit any more crimes.
Question: Why is a person with 50 previous convictions allowed to be roaming the streets? Anyone with that number of convictions has proved themselves beyond redemption and should be locked up for life (actual life - not wishy-washy "behave well and you'll be out in ten years" life).
This is why people take justice into their own hands; it's been seen time and time again that the courts are incapable of serving justice, so what other option is there?
It must be pretty frustrating for the police when they catch somebody for the 49th time and know the courts are just going to give them a slap on the wrist. Still, this chap is brain damaged now, so problem solved, I suppose.
As for the case, I side completely with the homeowner. I agree with what he did, but he should have been smarter going about it.

It wasn't planned revenge. It was a spur of the moment reaction carried out as part of the same ordeal. When under extreme pressure or shock people can do things they wouldn't usually do just because it is a natural reaction when you are under attack.
Yet two seeminly respectable, working family guys defend their property/family and end up in jail.

Well said,it makes me
that you get punished for protecting your own family and home and it's the scum that get away with actually breaking into your house in the first place.Escape from being tied up - fine
Protect your family & property - fine
Apprehend the criminals - fine
What him and his brother should then have done is call the Old Bill and let the courts deal with them, NOT smash this guys head into a pulp and give him brain damage.
Absolutely the correct decision by the courts. If these two morons hadnt got so carried away the criminal would be inside now.

I must admit I'd have probably done the same; seeing my family tied up and threatened would tip me over the edge, I'm sure.
This case interested me!
