Golf Shop Refund Problems
Discussion
Wonder if anyone else would find this annoying ....
Visited my local Golf shop and purchased a number of Shirts and a pair of Shorts.
When I tried shorts at home they came up slightly small.
So visited the shop again only to find only this size was in for this style due to been sold out at the moment.
Asked for refund on shorts and the shop refused pointing to a very small sign which is not clearly visable when making payment or entering the store.
They offered a voucher stating they do not give refunds.
Is this actually legal in the UK ?
Im quite annoyed about this and will not buy from them again so is this actually good business practise for them or am I missing something here ?
Thanks guys for your advice in advance.

No idea if it's legal or not, but there is such a large number of shops that say they don't allow you to refund.
If it's not legal, find the legislation and take it in. Or call your local Trading Standards offices and ask them what the deal is regarding the legality!
TBH, you could always find someone else buying something and get them a discount with your shorts and then them give you the cash?? I have always found this to work ok if a shop is being arsey about giving cash back.
Good Luck

Consumer Direct link
"You have no rights if the item simply doesn't fit"
Although I'm sure by displaying a sign saying no refunds, they're breaking the law - you need to talk to trading standards or consumer direct about that. Depends on how arsey you want to get with them I guess...

Additionally, from the Trading Standards website:

is the trader right?
(for England, Wales and Northern Ireland)
The law considers that the seller of the goods is always liable for breaches of contract, such as goods being faulty. You are only entitled to a refund if the goods are defective, not as described or not fit for their purpose (exceptions for distance selling and buying in your own home). Traders cannot state “no refunds”.

Thanks for the replies guys.
Would love to know if it is actually illegal.
I will be calling trading standards over this as its not about the money but the overall crappy business attitude especially in the current climate.
Can any Solicitors help out please ?
Many Thanks
I'm not a solicitor, I'm a barrister. I assume that will do?Would love to know if it is actually illegal.

Next time, try the stuff on before you buy it

No obligation to refund you as the goods are not faulty. Bad luck.

Next time, try the stuff on before you buy it - You are correct - Have to make more time next time.
No obligation to refund you as the goods are not faulty. Bad luck. - Fair point , But over a small dispute they have lost a customer who intended on spending much more during the next week fitting our clubs, additional clothing etc.
Perhaps I am been a pain on this but a simple transaction has annoyed me especially as the Customer Service factor appears to have gone out of the window which leaves me feeling a little annoyed.
Soovy can you confirm if displaying such a sign stating no refunds is legal or not ?
Many Thanks

There is no obligation to refund you as the goods are not faulty. The sign is irrelevant anyway.
Important points to bear in mind:
*
You have no rights if the item simply doesn’t fit.
*
You have no rights if you simply change your mind.
*
You have no rights if you have selected the wrong clothes for a particular use.

yes I bought these magic beans from Tesco yesterday. I planted them and over night no beanstalk appeared, nor was there a giant in a castle. I feel robbed, can I demand a refund for my out of character act of stupidity.

By all means call trading standards, but if you do what I say, you will be sorted regarding the money side of it!! Were changing rooms available/do they have them, becuase if not, then this may be a possible out??
Good Luck!!

I believe shops that have this policy on Sale items tend to refer to exchanges/refunds on sizing/colour etc, rather than faulty goods. I have returned faulty items bought in a sale (clothing items) where no refund/exchange policy on those goods. (I just tried my luck TBH).

Oh yeah I meant if it was the wrong size/didn't like them or whatever, I think they'd have to refund it they were faulty but shops don't have to offer any refund if the item was not suitable or the wrong sizeBy all means call trading standards, but if you do what I say, you will be sorted regarding the money side of it!! A grey area which has been cleared up for me !
They may not give refunds in the event that you simply purchase items which you don't like, BUT in the event of a defective item this would fall away.
Quick question though, looking at it legally. Is there anywhere for you to try on the clothes within the store? If yes, then you are scr**ed. If not, then you have a further argument.
