Orange want to take me to court for £40 !!
Discussion
Advice please , a year or so ago we moved from Orange to Sky, the Orange service had been very bad,and when we advised them that we wanted to terminate our contract they tried to make us stay by offering a free couple of months to see if their service would improve ...it did not so we got the code No and switched to Sky. Some time later we were asked to pay £40 for the 2 months that we had been given free. We disputed this on numerous occaisions in 'phone calls made by Sky at all times of day and night.
Sky have obviously now sold the perceived debt to another Company who are now threatening court action for its recovery. What is the view of the PH massif ?

Its probably too late now, but you'll get a default on your credit record if you dont pay it.
I made exactly this mistake, twice, after arguments with mobile phone companies. I just said "f
k 'em".
Ends up with a debt collection agency, who will hound you to the point of insanity and a big red DEFAULT no your credit record which will probably f
k up any chance of getting a high-street loan or mortgage in the current climate, it was certainly a pain to get my mortgage with them on my record and that was several years ago.
I know its a pain, but in hindsight I would have just paid it.

Its probably one of them things that you dont have in writing or never even thought to have asked for in writing.
I made the same mistake once with o2 they offered me an unbelievable (not actually that unbelievable TBH, half price line rental, cash back on my phone after 3 months, basically making the phone free) mobile phone deal to get me to stay with them, then denied all knowledge once i had signed up for a contract. I wont be using o2 again.
Im currently with orange but will probably change due to my bill being more a month than i was told it was going to be at the start (Probably down to carphone warehouse.)
I also paid off my Mastercard and forgot about it (it was paid off you see) then get a collection agency chase me for 100+ quid on it, the company had charged me 9quid interest after i had paid it off, i foolishly wasnt checking the statements, this esculated (SP) into a 100+ quid after a few months. My credit file is a tad red.
Also A-plan setup a loan in my name for car insurance without my consent, after i told them twice not to renew my insurance with them, thats probably affected my credit file too. I rang A-plan and asked them to explain "We checked your car and it showed that you hadnt renewed your insurance so we renewed it anyway" err yeah thanks for that..
Id already had new insurance sorted for over 2 months..

Exactly !! but the benefit of hindsight ! It is not the money it is just being held to ransom by some faceless company ! Orange recently tried this stunt with me - I thought I had cancelled a phone contract, but turns out they were still billing me for 3 months.
First I heard was when the letter from DLC landed on my doorstep. I called them and explained, and they of course said they didn't care, they just wanted money.
As it was only for £90, and I'm looking to get my first mortgage soon, I had to pay up, and am trying to claim it back from Orange now.

I conversely allegedly owe SKY £47 from similar circumstances several years ago.
They passed it on to one debt collection firm, who I explained the situation to and they returned the debt to Sky after realising I had recorded delivery letters etc.. detailing why I was leaving Sky.
Then about 6 months ago another debt collection agency contacted me. I phoned them back, explained everything and despite the woman on the phone being a right snotty b
h I haven't heard anything more since.
I would love them to try and take me to court, I've got so many letters I sent to them recorded delivery saying why I was cancelling the service due to them being a complete bunch of f
king w
ker buls
tting b
ds giving them notice etc..., all of which they completely ignored.
There are few companies that I would actually like to see collapse... however Sky is one of them, and the dealings I had with them 3 yeas ago still make my blood pressure rise... I can feel it now.

Heres another one for hating Sky with a passion. I moved house and Sky said they would just transfer the service and I need do nothing. Imagine my delight when Sky set up extra direct debits for the new address. Long story short, despite all letters phone calls etc they continued to take money to the tune of about £650. I finally had to instuct the bank to recover it, Sky then passed it to a debt collection company to recover the money they stole from me in the first place! You couldnt actually make it up. Two years of pain and I ended up losing out to the tune of £80 or so, but by that stage I was glad to see the back of it, its not worth the stress.
Funny too really, I had been a perfect Sky customer for many years, we had the full package and used pay per views on a regular basis, but even the dozens of managers I spoke to couldnt see the point in sorting out what should of been a stupidly simple problem. Although to be fair, I think the operations managers were located in the monkey enclosure at Chester zoo, so you shouldnt expect miracles!

Deny any debt.
Let them take you to court. Advise them that IF your credit rating has been adversely affected by their negligent actions that you will seek to recover any and all losses which directly flow from that negligent act.

Sound general advice.Let them take you to court. Advise them that IF your credit rating has been adversely affected by their negligent actions that you will seek to recover any and all losses which directly flow from that negligent act.
Although quantifying a loss from their actions could prove to be difficult. Not impossible but I can see it being hard to put a provable figure on it.
