Debt Collectors problem
Discussion
Just opened the post. I have a letter from Blair, Oliver and Scott Ltd Debt Collectors.
They are saying they are collecting on behalf of Bank of Scotland for £6572.06!!!!
Now I dont have any debt with the Bank of Scotland, or to this amount to an individual.
Is this some sort of con perhaps?

Having read all the threads about this in the past, I think what they're doing is just mailing out this crap to anyone who shares the name of the debtor and hope that someone will bite.
There's a letter template somewhere on the internet that you can use that basically says you do not acknowledge that the debt is yours and that you want proof that it is before you discuss this with them any further. Might be on moneysavingexpert.com but I'm not 100% sure.

I nearly had a corronary when this dropped through the door. There's a letter template somewhere on the internet that you can use that basically says you do not acknowledge that the debt is yours and that you want proof that it is before you discuss this with them any further. Thanks I will have a look around then.
There's a similar type of annoyance where something called The Winged Messenger or other daft company name sends out bulk mailings to people with name or address connections saying You have been contated by The Winged Messenger please call us on 01234 567890. No reason given.
This blanekt bombing approach to debt investigaton should be illegal, it's nothing less than condoned harrassment.

Write back to them and ask for a copy of the credit agreement they're trying to collect from you.
Could be an ID theft problem, a neighbour had something along those lines with Littlewoods catalogues. They had to jump through some hoops to prove it wasnt them, but all came out fine in the end re credit records
Worth doing an Equifax or Experian report for backup

Whatever you do don't call them. If you do and then give your name then they have your number and will use it, a lot. As suggested above do it all in writing. There is indeed a template letter somewhere on the internet but just doing a search on the company name will probably bring it up through loads of complaint and financial advice type websites.
From your profile, you're in England.

Well I did call them. I have managed to sort it. They said they will check it up but might be clerical error, as he didn't have the reference number. Is this right? or are they fobbing me off.Try: http://www.nationaldebtline.co.uk/england_wales/te...

I'm not very good with money management issues, but I know what I owe and who too and make sure it is paid before I even buy anything for myself.
These debt comapnies are usually not a seperate entity but part of the company seeking the debt, usually a PO box is listed.
I have been getting letters for a guy who used to live at my house, before I bought it, and he owes about 2k (had a sneeky look!) and they keep saying we will send balliffs round to collect the debt, this has been going on for four years now.
I am just waiting for them to turn up so I can be all smug and tell them to f
k off!

Is this alleged debt due to a credit agreement? If so this is what you need to write:
It would also be worth checking your credit record with Experian - just in case this "clerical" error has got as far as your credit record.
Speaking from experience here - 3 year battle with Akitv Kapital
Good luck and I hope it gets sorted.

I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.
1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxx.
2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.
3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not.
Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.
As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.
Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.
They will fail on all 3 if this is a scam so them you can get the office of fair trading involved.1. You must supply me with a true copy of the alleged agreement you refer to. Blair, Oliver and Scott and the inhouse collections team at BOS.
Just send them the prove it or naff off letter. (thats the CCA letter posted above)
I had this with a company called Buchannan, Clark and Wells, chasing a £5k debt that I didn't have with Lloyds. Lloyds agreed that it wasn't me, but for some reason every time the company tried to find this girl in Stockport, she ignored them, and it went to the next on the list, it seems my married name and date of birth are the same as hers. But I'm not in Stockport! Been through it twice with them so far, and have told them that the next time they chase me for this debt, I will allow them to take me to court, as I have all their letters saying it's not me (when they have had a kick up the arris from Lloyds) and letters from Lloyds saying its not me.
Haven't heard from them for while.
