Needing some PH wisdom here.

In February of this year I received a call from an independant company (lets call them freeupgrades.co.uk) that sell 3 network phone contracts. They gave me a good deal over the phone on an 18month contract and I went for it.

They transferred my old T-Mobile number over to my new phone, and that was that, everything seemed fine.

Fast forward to 1 month ago where I call 3 asking to upgrade my price plan, I tried explaining to the Indian woman down the phone that i wanted to upgrade my price plan, however she couldn't understand me and I couldn't understand her, so I put down the phone.

Within a few days of this, the same company (who we are calling freeupgrades remember) phone me to announce that I am eligible to upgrade my contract. Great, I think. They offer to upgrade my current contract & phone to an 18month contract and I go for it once again.

They put me through to the manager to finalise all the info where I notice something odd, the manager says:

"we will be transferring your number from your old T-Mobile number."

To which I say to him "okay but you have already done that months ago when I left T-Mobile, my number is with the 3 network (the network they are trying to upgrade me too)"

He says this is no problem and we proceed.

They send me the phone the next day and when I receive it I see the little yellow slip of paper that transfers your number and I notice once again they are trying to upgrade my T-Mobile contract (they done this already)

I've had the phone for 4 weeks now, haven't used it. But apparantly I'm beyond the cancellation date.

I'm not particularly good at explaining things so here is a checklist of all of the above

1) In feb 2008 I upgrade from T-Mobile to 3.
2) In August 2008 I receive call about contract upgrade, go through with it untill
3) I notice they are upgrading me from T-Mobile to 3 (again, althouugh T-Mobile contract&upgrade happened 6 months earlier
4) I receive phone
5) Call the 3 network up, explain situation and they block the NEW sim and cancel payment
6) I receive 2 bills from the 3 network for 2 contracts.

Any ideas where I take it from here?

Apologies if it's hard to understand.. I am rather terrible at explaining things :s

Go to you local 3 shop, explain what has happened and tell them there is no way you are paying 2 bills or one number...

(preferably head there on Saturady about 10 minutes before closing time and refuse to leave the shop until it is sorted)...

I think you're pretty stupid for going along with it the second time. You get an upgrade in February and 6 months into an 18 month contract you get a call asking if you'd like a free upgrade. You won't be eligible for any more upgrades until about 17 months into that contract.

Will agree it's a pretty daft mistake on my part.

But also a mistake on freeupgrades part as they offered me an upgrade to the contract they already upgraded.

I thought it was more of a priceplan upgrade but didnt really click untill I received a new phone & sim.

Sounds like it's all down to them then, have you tried phoning them to explain their mistake? I don't think the blame is down to three as it's this third party company that has taken out a second contract on your behalf and led you to believe that it is a genuine upgrade.

I phoned them and they said to send the phone back to cancel, problem is, the 14 day cancellation window has closed. I could try sending it back now, although not sure where that will leave me.

Three network are properly utterly useless, i got a contract phone from them but they never activated it, 2 trips to dundee to the shop and phoned them everyday for around 3 weeks and they still never activated the contract. But they would send me monthly bills for £0.00, so after three months i went and got a three payg card and stuck it in the phone, works fine, i suppose i shouldnt really be complaining as i got a free phone...
