Private roads!!

We live in a terrace house which has a private rd for access. There is room for about 10 cars to park on the side of this rd, one of them being my works van.
We now have a crappy old van parking in our road for about 1/2 weeks at a time,(sometimes he parks his other motorhome there also) the owner does not live in our rd. We have put a polite note on his van stating that this is a private rd, and would he mind not parking there, as we only have a limited amount of spaces for our cars.
He has now parked his van there again, with a note on the inside of the window, saying he is dissapionted we didn't make the effort to find out who he was, and speak to him about this personally, and he is now not moving his van until we do!! Given us his name and address, and written a few other cheeky things also! Who does this W
r think he is, he has NO right to park there, and he expected us to knock on every house in the surrounding area to find him!!

Anyway, where do we stand?? Can we get the police involved?? or council..

Is it a private road or a private access? The former has a "public right of passage (not necessarily a public right of way). Is it lit? Is it signed? Is it gated?
If it's a private "road" ie a public road but privately maintained, then the only people who can control parking on it is the local highway authority - ie the council. They can only do that by making a Traffic Regulation Order to put down yellow lines to Traffic Signs Regulations and General Directions. That Order would apply equally to everybody, residents and visitors and your van driver, unless the TRO promoted a residents' parking scheme (and you know that's not going to be free, right?)
If it's a private access (ie no public right of passage) then you can put up a notice and/or a gate and get the police or a nasty clamping company to enforce it.
If you're in doubt, ask the council if it's a road or not. They will mostly define a "public road" as one which they maintain - that's the lazy definition but not the definition in the Highways Act 1980. You need to find out if it's a public road (privately maintained) or a shared private access.
