Coke then sue Joe for using their copyrighted brandname (without payment or permission) for promoting his business. Joe looses, pays up XX million. Joe then sues shutterstock for his loss plus legal expenses.
Whether shutterstock come after me or not I dont know. They train their reviewers not to accept photos with brand names, logos, trademarks, company names, etc.
How does a newspaper get away with running hundreds of photos each day, of copyrighted things like ipods, coca cola bottles, etc? Simply because the photos are not promoting anything, for they are being used ad "editorial"
Shutterstock is one of the sites which lets users submit pics as "editorial" Thats my understanding of how it works.
Petrolhead story: (long time since I heard it, its accurate, I think!?!)...
In ferris buellers day off, a ferrari 250 GT California was used. The car was a replica. The company shooting the film made the mistake of putting the ferrari badge on the car without their permission. Because the car was a fake, and brand association was sought without permission... I think ferrari sued and destroyed the company who shot the film (cant remember). Im sure someone will correct me if Im wrong
Colours can be copywrited through association. In england, a chocolate bar was taken off shelves, because cadburys insisted the purple wrapper infringed upon their "purple wrapper/chocolate treat" brand and image that they had built up. The shape of a coca cola bottle is even copyrighted, as are many fragrences, and designs like ipods, TVR's, etc.
