If it doesn't have a BS Kitemark yes !
I suspect you've fitted an aftermarket straight through race can which will also have something along the lines of "competieion use only" or "not for road use" stamped on it. This does apply to cars as well as bikes and is what plod will look for. The rules on noise levels are to complicated to be enforced even with a Db meter as was tryed at Boxhill a few years ago.
Basically "Traffic" turned up after loads of complaints with newly aquired straight from Tandy Db Meter and started poking it up exhausts and saying "over 97Db's your nicked" Not so noise levels have to be measured in controlled conditions, i.e an open space the bike is then riden through a marked area at a constant rev level and past a stationary meter. This is the responsibility of the manufacturer and once approved there is nothing that can be a done to the individual for a noisy can (as long as they haven't altered it or its blown) as it will either have BS or CE approval. By the way all Ducati 996's currently fail but they've got the badge so tough.
