Hi there,

I am in need of some advice as i am not entirely sure on the subject
Here is what happened:

I bought a Motorbike off Ebay.

I noticed today that there was a crack on the engine just above the chain where oil was seeking out which was being covered by silicone (botch job)

I got in touch with the guy i bought it off and asked for a refund, he said that he had only had the bike for a couple of weeks and wasnt aware of any crack he had just sold it on, also he said he wasnt sure about giving me a refund and the money had already been allicated. He said he would phone back tomorrow to discuss it further.

So there is my situation, how should i go about it and do i have the right to a full refund as it was all done through Ebay? Also a friend of mine who is an Engineer said that he would be able to spot weld it, would this be worth doing? My fear of welding it is that the crack gets worse and it starts leeking oil again.

Many Thanks,
Grant

Hate to say it, but with ebay, caveat emptor is the general rule. I bet he knew about it though, but theres probably no way to prove so.

My advice? Don't put vegetables in the oil filler.

Not EBay my friend Auction rules always inspect the goods or bid a price that you would pay for damaged goods

I would think 'bought as seen' I guess its one of the risks of buying off Ebay.

did the ebay ad for the bike describe it as good condition and without fault? do you have this on your pc? If so, maybe you could use that information to try and get a refund.

best-case scenario is you got a receipt saying there were no faults with the bike, signed by the seller... I'm guessing this isn't the case? If you bought it "sold as seen" there is probably nothing you can do sadly

Even if you feel like the seller (I would), I would try and be nice as pie until it is clear he is not going to do anything for you....then let him have it he must have known about the problem. hope you didn't get stung by too much

Hope you can fix it and you didnt spend too much...
ebay can be really good for bargains and really awful if you get conned.

Oh dear. Don't expect any help from eBay; when I had a dispute over a CD changer that arrived broken they were more interested io protecting the seller than the buyer. Left -ve feedback but that didn't help much!

If you want to keep it, get it welded, or if you don't, bung it back on eBay asap.

if you do put back on ebay... stick it under another user name, will look dodgy if you are selling on so fast

Until you leave feedback, it doesn't appear in your history. So best to skip the feedback war and move on.

Is a cracked casing on a 125 crosser gonna be that hard to fix/replace??

Shouldn't do, those things are designed to get chucked about.

Might no be TOO bad, but on the other hand?????

I too bought a bike off EBAY a few months ago. It was a Honda Varadero 125 and the chap drove it down the next day in a van to London from Bradford! My bike was simply perfect - he was honest and it was a great buy. I have since sold it, bought a Fazer 600 and kicked myself for the risk I took at the time as I think EBAY is not a good place to buy this kind of thing, it is simply convenient if you (as I was) am lazy.

I was aware that if it had been a dud, I had no leg to stand on. I am sorry, but I think you are not in a good situation here - it is now officially your problem. That said, at least it is not a £40k car - I hope it doesn't cost much to sort out and hopefully with the money you saved it will balance out. I guess it's a learning experience - which scares the res of us when things go wrong!

I've sold cars on e-bay and just try to be as honest as possible..but ultimately the cars are sold as seen.
I always describe them as no know faults and been very honest with the body work & interior. That way I'm protected ifr the car goes bang two days after its sold. Which obviously can happen with any car ebay or otherwise.

I just went out to try and get a picture of the crack but its too small for the camera to pick up. Also i had a bit of a closer look and i think i can gather what happened it looks like the guy had been riding it and the chain has snapped came round and smacked the engine and cracked it, im thinking this because there are pretty deep scratches on the swing arm where it looks like the chain has came off, plus its just a brand new chain and sprocket kit been put on it. If this what happened he must have been going well fast.

If it's where I think it is from your description and it's a fairly new KTM I think you'll find it's a magnesium case cover in which case it's not weldable without very specialist equipment and certainly not "spot" weldable, check first before you let your mate near it and if it is ali' and on the main casing it's an engine out full strip job to be welded, if he strikes an arc on it with it still all in place it will fry your ECU. Also make sure you drill both ends of the crack if you weld it otherwise it will just go again.
