Would he have got a ban?
Discussion
Ime taking a Chelsea fan home last night and talking football,we start to get on the subject of Jose and ime driving around a roundabout when all of a sudden a car comes flying round the roundabout anti clockwise.
I pull my cab out of the way and to an abrupt halt and we can see the driver is on his mobile and the car has its side lights on,at this point we are both FFS whats he on,question is wether he done this on purpose or by mistake how many points would he have got and would this dangerous driving constitute a ban if the police had caught him.

But was he speeding?
Yep,i thought he was doing more than the 30mph stated but i doubt if that had made a difference if he had hit anyone, his style of driving was appalling,i will add he turned right off the roundabout and drove up the wrong way of a dual carraigeway. planetdave said:
It depends which offence he gets prosecuted for and who is judging.
I thought of a few offences that could be applied but would need a resident cop/legal head to varify.
1/Driving whilst on a mobile phone ,3 points.
2/Driving without undue care and attention ,4-6 points.
3/Dangerous driving ,4-6 points.
Maybe 11 points at the very max.
It got me thinking that someone that drove so bad and put a genuine risk to others safety could get away with a ban whereas someone doing over a ton on the motorway at the same time of night with no risk to others could risk a straight ban?

It's not normal to add the points together (just the most serious) so if he got a 'due care' then that would only be a few points. However in your case it would probably be 'dangerous driving' which has a obligatory disqualification (excepting exceptional circumstances)
Gotcha ,
