Not Fit for the Purpose?????
Discussion
Ok guys and girls i need some advice........
A few months back I bought a Quad bike on behalf of my company, the purchase price was O.T.R - and it was sold to me/us as Road Legal
I supplied the dealer with insurance certificate etc paid the money etc and collected the quad (prior to reg certificate/number being issued) - we need it on a job - Not on a Public Highway.
In short DVLA requested further info, proof of registrant, I.D. etc - not happy with giving the dealer my passport/driving licence I collected the paperwork from him and took it down to the DVLA office in person.
3-4 days later we get a call from DVLA telling us that they cant issue a reg number and we cant register the vehicle as the 'Certificate of Conformity' is incorrect - no problem says the dealer we will sort it
Long and short of it - We are still waiting  they chap at the dealers is slipperier than a slippy thing and getting to speak to him on the phone is mission impossible, he never calls back and gets his staff tell us 'Its in hand, will be sorted by the end of the week blah de blah de blah'
Its been sitting doing nothing for ages, the fuel pipe perished and dumped a full tank of fuel right over the engine  lucky it was parked and not being used - ranted at the dealer about that - his solution - post us a roll of fuel pipe.
My boss is doing his nut - I was taked to purchase the quad - he now wants it sorted pronto!!!!
So can I take it back and get a refund as it is not fit for the purpose for which it was sold to us????

Yes, basically. But if the dealer's being generally evasive don't count on this being an easy process.
It may however spur him into sorting it out properly.
I've given up trying to phone them.
I was thinking along the lines of loading it on the back of one one of our motors and driving up there (not local to us) and asking nicely for a full refund
