This is what this country's coming to....

Client owes us money - never paid anything despite numerous requests....we have contacted next of kin ( as given by client on original application) and now we have Trading Standards threatening prosecution as we have "caused alarm, distress and humiliation..."

That is ridiculous - on whose behalf are they threatening action? The non-paying client?

I would suggest that nobody has any right to chase next of kin for payment of a debt unless next of kin has underwritten it in some way. Seeme a bit extreme going to trading standards but I guess it all depends on the level of pressure applied.

Agreed - we weren't. We sent a letter to the debtor c/o the next of kin's address....

And we always advise at time of signing that is the reason that we require information of the next of kin.....
