I have purchased a brand new Mercedes recently. It was sold to me as new, but on receipt of the car, I found so many defaults, e.g. broken interior, defects on body paint alongside with many other problems. Dealership offered to fix it for me, but every time after the appointment it has new issues came out. So the car has been back a few times. In my recent body paint fix appointment. They have badly scratched the cover the A pillar, after a professional inspection noticed this panel has been removed and didn’t fit back in properly even. Not talking about they have lost my personal belongings in this appointment too. I don’t understand why does a body paint fix involved touch pillar cover? The car is brand new too. What were they doing with my car? I am now not sure if they have swapped any parts of my car, really can’t trust the garage anymore. Have you experienced this before?

Are the bodywork issues sorted?

No you're not being scammed but you are receiving very poor service from the dealership.

Is that a scam? No.

What you need to do is complain in person to the dealership involved, not to a set of randos o' t'interwebs.

Somebody is being scammed. Yes.

But what you can do is reject your brand new car as not of satisfactory quality.

The first thing I’d want to establish is whether it was genuinely a new car. From the number of defects, paint issues and trim that’s apparently been removed, I’d be wondering if it had previously been damaged or used as a demonstrator.

That said, even if it turns out to be a used car, buying from a dealer still gives you significant protection under the Consumer Rights Act. The dealer can’t simply shrug off faults that were present at the point of sale. Given the number of issues and failed repair attempts, I’d be keeping a very detailed paper trail and considering a formal complaint.

Thank you. The issue I raised was fixed, but new scratches on different parts of the car when returned. Also noticed the A pillar cover has been disturbed as it is now damaged and loose. I can’t understand why fix an outside body paint would involve touch pillar cover?

Thank you very much. Yes, I questioned them on the first day when I received the car. They said it is new one as it would illegal for them to sell a second hand car as new one to me. But they have dealt with the issues incredibly slowly, each simple appointment took more than a week to come back to me. It is just over a month. I was trying to be patient and let them bring things right. But this time makes me really completely lose the confidence on them. As I really don’t understand why fix a paint would need to touch A pillar cover. I am so regretting buying this car from this dealer. Would I still be able to return it?

Like what? And have they been fixed?

Rejection is usually required within 30 days of purchase and you can only reject if there's something wrong with the car in terms of its description or condition. If it's been in and out of the dealership and still has significant faults you could probably still reject but "I'm suspicious it might not be new" is unlikely to tick that box.

What mileage did the car have on it when you purchased it?
Put the registration number into MOT history check as this will show when it was first registered.
Maybe it was a static demonstrator.... wink

Not scammed as such but if as you say then just appalling service.
Being brand new what has the salesman said and if nothing then speak quickly to the Sales Manager and if necessary the DP.
