Did you always need planning permission for a swimming pool?

Another spanner in the works with selling the late FiL’s house.
He has a large swimming pool which was installed in 1991. There is no paperwork, apart from bills.

He left all his bills, he had permission for everything else, and all the papers are there, so this is a bit of a puzzle.
He said he had it done along with that of a neighbour, who was a police officer. I can’t imagine him just saying “b

ks to it”Can only speak for Dept 87 (Haute-Vienne) but yes, we needed planning permission in 2000 and had to submit all plans to the Mairie initially and someone came out from the Dept. to measure up when it was completed. Surprised it hasn't been picked up before as it will be obvious that it's there if you look at the detailed Cadastre (which is built up from overflying surveys).
Has someone raised it as a problem then? It might be worth enquiring at the Marie as to what the rules were at the time.

A friend sailed close to the wind about 2010.
He bought a kit with wooden walls and a liner. It was classified as an above ground pool, but by the time he put decking around it, it wasn’t. No planning and no increase in value.
When I built in 2004, the pool was part of the planning application and required a completion certificate. I would imagine that it will need retrospective consent with a clear indication of how water will be disposed. They did not allow it to go to the sewer and my neighbouring vignerons were not happy about a soak-away, but that was what was approved.

Is the pool mentioned on the tax d'habitation? In the papers is there mention of a tax d'amenagement for it? If so, especially if you still have those papers going back some years, it is obvious that it was declared as he was paying tax on it.He has a large swimming pool which was installed in 1991. ks to it”I installed a 8 x 4 pool in 2002 and needed permission , I seem to remember it was size related at the time .
Have you got the necessary safety measures in place , locked gate , fence , alarm or a mixture of all ?
It will be questioned by the notaire on the sale of the house , I didn’t have on the sale of the second house but seeing as you sit in the same room as your buyer when exchanging just make sure your telling the same story and you’ll be fine .
This goes for fittings and furnishings too .
