Our 520i developed a minor oil leak from the front undertray. This was repaired last year - was in the last 2 weeks of factory warranty. All good.
A year later, it's leaking again. My wife insisted we buy Insured Warranty, and I've taken the car in to the same dealer to get it looked at, surely enough it's the same seal that seems to be leaking oil.

Question; do I have to pay excess from the Insured Warranty policy? does it not make sense that the previous repair was not done properly therefore it's not really a "new" issue?

My understanding is that the new car warranty is 3 years from date of registration - any parts fitted during the warranty are covered until that time.

If you "purchase" a new part it is covered for two years (even if you only pay part of the cost.

I would be seeking confirmation that its the same fault as previously and if so asking them or BMW to cover the cost on a "goodwill basis" before involving the warranty company.

As said above, the seal fitted under manufacturer's warranty would just be covered until the manufacturer's warranty expires.

Also regarding the "insured warranty" double check the T&Cs as normally seals are excluded and not covered.

FWIW the warranty company is still BMW - we went for the BMW Insured Warranty. I will see if they are willing to tell me what they did to the car last year vs what was replaced now.

I'm guessing it was the rocker cover gasket. Done 3 times on my 35I Z4 fro memory first time it was the seal that had gone, so replaced. Second time the rocker cover was cracked/warped or someting similat. Third time was the seal. Or could have been other way round-cover then seal. But because each time it was a different fault had to pay £250 excess. Could argue that a new cover would include a new gasket. However as other work done at the same time for last one when car was in my ownership I was paying the £250 anyway so didn't take any further.
Nearly all BMW's have rocker cover gasket leaks so find out exactly what was done on last repair i.e just gasket or cover so if it crops up again in next 2 years you may be able to have done without paying excess.

.If you are new to insured warranty the excess is per claim not per item so can have multiple items done as part of same repair - i.e fuel pump, rocker gasket and oil housing gasket all done at same time on mine excess still £250 not £750
