Pushy salesman at main dealer

Back in the Autumn, I ordered a new Ford Focus from my local main dealer.

My personal circumstances have since changed and I no longer want the car. However, it's arrived at the main dealers earlier than forecast and now the sales guy is telling me that I have to take it.

Because it's been delivered to the dealer, Ford have closed down my online account, So I can't access the documentation to see if there's anything legally binding.

Does anyone have any thoughts/knowledge/experience?

Have you got a contract? And within that contract is there a committment to buy? Have you paid a deposit?

So, you entered into a contract (as I understand it) but did not save any documentation/e-mails?

You need to get a signed copy of your order paperwork from the dealer, the devil will be in the details

So the salesman is being "pushy" because he's asked you to take delivery of the car that you were happy to place an order for?

If I were the salesman, I'd be delighted to cancel your deal on the basis that I'd never need to deal with you again

It sounds like you've been incompetent rather than the salesman being pushy.
Find a copy of the order, review the details, find out if you're being unreasonable.

I ordered a RS3 which I cancelled when on the ship over here. Dealer not happy but they eventually returned my deposit.

It was all done online within their portal. And now I'm trying to access them, they're no longer there!

The deposit was only £199, so I'd be happy to accept losing that

For starters, the car turned up early. So I haven't sold my current car yet. And now he's putting pressure on me to sell it trade when I know I will get more privately. It's a huge downgrade from what I currently drive, so not overly keen to do it anyway. But needs must. Now he's pushing me to trade mine in, I've taken a dislike to him because of his attitude.

It's not my fault it turned up 6 weeks earlier than I was told!

Maybe just tell them you will collect it in 6 weeks, as expected, and that gives time to sell your car.

The paperwork may show you must take delivery when it arrives but they would then need to point that out to you, at which point they will have supplied you with the copy paperwork.

Just collect it when you expected to collect it. Surely taking it in March on a new reg will be slightly nicer too.

If the car was ordered as "tailor-made or personalised goods" as from the above link then it may not be that simple.

If the car was ordered as "tailor-made or personalised goods" as from the above link then it may not be that simple.

Car don’t normally qualify as that IIRC as they’re (mostly) built from a specified list of options.

I suspect if you went PTS bright pink with camel dick leather it might be a different case….

If the whole transaction was completed online or by phone with you having never set foot in the dealership, you can cancel and walk away with a refund of your £199 deposit.

I do find it odd though you don't have any paperwork!

Based on OP's earlier posts and Pica-Pica's earlier (unanswered) question to them, my guess is that they will have had paperwork they just never bothered downloading a .pdf copy of it from the online portal at any time since they placed the order.

Car's now been delivered, account closed by Ford and OP has crapped themselves realising they now can't get access to the agreement because they never read it - just like a large number of people doing everything online but forgetting to keep a copy of any agreements thinking it will always be available online (until it isn't like now).
