Hi All

Can you help I bought a van off a fair sized commercial vehicle dealer today for 13k. Part of my decision was based on the 700 quid they said they had spent on discs and driveshaft for which they provided receipts. When I got home i checked the van and all the discs were worn and no new drive shaft had been fitted. I left a deposit online went to the dealers today test drove and paid bank transfer. Have I rights to return the vehicle or do I need to seek trading standards advice etc?

Simply yes you do, go back today & get them to either refund you or carry out the work they said they'd done, that's ass uming you're happy with the rest of the van the later may work best for you.

Not an expert, but doesn't the consumer rights act apply to non business transactions?

Ie a business to business transaction might not have the automatic right to refund

(Although this is a clear case of MIS description of not outright fraud)

its actually outright fraud I'm in shock as I thought medium size dealers were above this level!!

You could not be more wrong.

If the van was collected from the garage you can’t send it back. Vans are also tricky even if they are distance sales as they are normally seen as a business to business sale so very little comeback. Having said that if they had claimed to have done the work have a chat and ask them to inspect it again and hopefully complete the work.

If they provided receipts for work and it hasn't been done, business to business or not, it's clear misrepresentation and fraud.

They have said it has new discs pads and drives haft gave me invoices for these they are years old and lipped and rusted!!!

Ok i stand corrected, you may bot be able to get a 14 day refund if you have purchased the van through your business.

But the receipts are fraudulent , when you go back take photocopies and not the originals.
Make it clear its fraud and be calm but clear if they do not resolve the situation to your satisfaction your next stop will be the plod shop.

When dealing with liars I have to keep calm and factual im actually going to keep the van as they would screw it up far worse if I let them touch it. They obviously do this to all punters. I just need to decide if I want to go to trading standards or let it slip and get on before I have a heart attack

I know, try not to get stressed. It would certainly wind you up when you know they are lying to you too.

Like with most stressful/infuriating things in life, its best walk away (for the weekend) and revisit it next week when the dust has settled.

Try and enjoy the weekend hippy

Never believe anything a car or van dealer tells you unless you can see it with your own eyes.
Hope you get it sorted though, take some time to look over the rest of it while you can but generally vans have a very hard life.

There was a scam run by BT called BT customer street that targeted 2 bit tradesmen with high pressure sales techniques - of the very kind that brought the need for for consumer protection - then when the guys put the phone down and realised the worthlessness of what they'd agreed to, found they were in a "contract" and attempts at cancelling meant very aggressive lawyers and that BT defined consumer protection as not applying to biz2biz.

I'm no expert either but it seems to be a case of enough doubt that its who can be most intimidating and threatening etc and who just wants a quiet life and doesn't know where to seek help.
