I'm guessing the top teams have people as effective at ensuring their spending is seen to be within the cap as the FIA have people effective at proving otherwise.
Compare the same battle between the FIA and the teams in terms of the regs. The FIA have a group of highly experienced people charged with the sole task of putting together and maintaining a set of regs with no wriggle room or exploits - but then the teams find the wriggle room and exploits and effectively dictate the re-writing of the regs in doing so.
The FIA are always, in a sense, on the back foot. It's as if they aren't as passionate and thorough about making rules as the teams are at undermining them
EDIT: Not suggesting anyone is cheating the caps - just pointing out they regardless of foul play or not, they will all have their accounts sewn up in a neat package that will meet the expectations of the FIA accountants. They won't have been scruffy in their record keeping or have exceeded the set limits in any demonstrable way. Except Ferrari - whose business model makes the idea of even a self imposed cap on the F1 side almost impossible to achieve, let alone a cap imposed by the FIA.
