New £450pa VED for £40k+ cars...

Hello,
Does anyone know if the £40k threshold is from the list price on the car or OTR price of the car?
I am ordering an Audi S3 Saloon Black Edition S-Tronic with a couple of must have options (for me) and the OTR price is coming in at £41k but the list price is just coming in at under £40k. If its based on the OTR, it will be a no go, if it's based on the list, then I'll order one up.
Anyone know for sure? It seems the dealer networks aren't really sure either when prompted.

Didn't realise that the additional £310 rate was for next five years after you bought the car, assumed it was just the first year!
£39,999 will the most popular price for mid priced cars going forward now as people simply won't consider any car in the £40-50k bracket, if the base package scrapes in below £40k then I doubt people are going to spec options that pushes the price past that.

Are you really going to forgo a new £41,000 car because of an additional £310 per year tax charge? After all, life is short and it is a relatively small cost compared to the cost of the car itself.
I presume that your position is based on a point of principle, rather than not being able to afford it?

And it can make a larger proportionate difference to a lease cost if over 2-3 years you're adding on an extra £620 in tax - just because you ticked some cheap option that would be £2/mth over the term before now becomes £20/mth.
OP - I don't think I got a definitive answer from an authority or someone in the exact position either in the above thread, but depending on your circumstances see if the options you want can be retrofitted afterwards or maybe try and get the invoice for the car separate to the charges for delivery and number plates? Is that possible?

It would be an additional £310 for 5yrs before it then reverts back to the £140 so a £1550 additional fee if I were to keep the car a full yrs from new.
Yes, over the 2yrs it would 'only' be an extra £620 or £26pm ( £620 / 24 months ) but I suspect trying to sell the car at 3yrs old will be quite difficult. Once upon a time it was worth £41k but then at 3yr when it's worth £20k, that new owner has to pay the additional tax for another 3yrs. (They would surely just source a similar car with a once upon a time smaller list price?)
I think it's going to have a huge knock on effect personally. I wonder if the V5 doc will have a list price new section on it to keep track through multiple owners?
I had to remove my pearl coloured paint choice to make it work, it's listing now at £40,800 OTR and £39,790 list so after consultation with my dealer and a call to Audi HQ, they are confident it now comes in under the threshold. (June delivery)
What a pain but yeah, there's principle involved in there too. I wasn't wanting to just literally breach the threshold by a few hundred pounds. If I am being forced to pay the additional I'd want to be quite a bit over that threshold with no other choice.
