Hi All

At the start of December I had the pleasure of being knocked off my CycloX bike. The driver admitted full responsibility and is insured with Esure. Their engineer has agreed that the bike is written off as the frame is snapped in two places (despite being aluminium!).

They have agreed payouts for the kit I was wearing but have depreciated the bike quite a bit as it was bought in 2012. I would say that the bike was mint - maintained perfectly by my local bike shop. Long story short is that it cost me £1650 to buy as a custom build and the bike shop quoted £1530 to replace like for like. Esure have offered £750ish as a payout. I've gone back to them asking for the full amount but just wondered what other peoples thoughts were?

It's the first time I have been through this and I'm not sure what to expect.

Ouch that's pretty crap

Do you have any legal cover? Are you a member of any cycling organisation or home insurance , if it was me I would be tempted to start getting proper legal advice.

I would argue with the insurers that with the £750 you have to find/inspect/transport a second hand bike or buy a new bike which will be lower quality but newer, essentially either option leaves you worse off due to an accident you didnt cause.

I am insured with PedalCover who I assume would help but I am a little wary of getting them involved in case my premium goes up next time. It looks like I might need to get a solicitor involved for the injury side of things so maybe they will handle this at the same time?

Yeah, sounds bad but solicitors will be clambering for your case if you are injured

Im suprised they gave you such a poor offer if you were injured

I would speak with pedalcover and get them to act for you

You could do worse than give this chap a try... richard@bikelawyer.co.uk

Richard Dykes. Bikelawyer started as a motorcycle specialist, but moved into representing cyclists. You might well end up being told that the depreciation thing is legal and reasonable. But he's very approachable, patient (talked me through the whole process) and a realist. Won't fill your head with hot air and dreams of a fortune in compo. But when I got wiped out by a van at a roundabout I got a far better result than I was expecting (or pushing for).

What's the worst that he (or they) can say? They might not be interested? Got to be worth a try, if you're looking to go down that route.

You won't have any actual right to 'new for old'. It sounds pretty fair for a secondhand bike a few years old.
