I recently had an advance on a Mortgage with the Woolwich and (5 weeks after completion) they've contacted me to say the figure they provided to the Solicitor was short by £900 and want me to pay it. My argument is they dealt directly with the Solicitor, provided an incorrect figure, I then received the monies in good faith and in the true and honest belief the figure was correct and have since spent it. Since the initial contact and my protestation saying they're liable as it's their mistake, they've offered me £200 for the inconvenience and still want me to stump up the balance - anyone know where I stand?

What would be your view if the opposite happended and the bank had made a mistake in their own favour?

Would you be happy that they didn't pay you the missing balance because you didn't spot the error at the time of completion?

I hear what you're saying but it doesn't help really does it. You're arguing a point of 'fairness' rather than 'legal liability'.

Good for you, but the legal liability is yours.

As you already know, you need to pay, their fault or not.

As it is their cock up though, they have to be reasonable in letting you pay it in a way that is affordable to you, I.e £50 a month - with no interest either.

Pay up and move on
Be thankful they are offering £200 for you doing nothing to earn it.
They employ solicitors etc so coming after you for monies owed will be no skin off their nose.
But when you next want credit this may appear on your record.
