Personally I'm in favour of Darwin but when the authorities pipe up with 'Ooh all the passengers could have been killed!' you think they might be more bothered.
The blunt truth is that they take a view that the occasional life is not worth the cost of a few gates (or if they are to be believed, those of driver and passengers as well). They should try saying so.

Same issue - of "blaming" the railway infrastructure, when a car or lorry strikes a bridge the bridge has to be closed (to rail traffic) for inspection causing untold delays.
However the passengers will blame the railway yet again.
I don't know if the railway can seek compensation from the vehicle owners.

Yes Network Rail do claim any incurred costs back from bridge strikers, not sure about other misdemeanors.However the passengers will blame the railway yet again.
