100k or 40k ????
Discussion
i'd say both are at least £500 over priced, but thats just bargainging room.
What sort of history do each have. The higher mileage older car might have had lots replaced. Is the 2004 car a 54 plate and therefor facelift 170 bhp?
If it is being used on track, does it have a LSD? Many came with them, but it was an option IIRC.
Watch out for power steering pump issues, check condition of exhaust especially back boxes as they rust in the edges, check to see if the timing chain tensioners have been replaced, they are plastic and fail causing big damage - google mini death rattle.bushes and anti-roll bars should be squeak/rattle free.
If you are handy with spanners get cheaper older car, bear in mind people say the supercharger should last 100k no probs but the oil should have been changed by then (overlooked) and it could be costly if it goes but 2nd hand ones available.
At this age and budget though i might be swayed to the newer less mileage car.

if you are planning on tracking definitely go for the facelift, better super charger giving a few extra hp and closer range gearbox
not sure you could get the lsd on the pre face lift either
from jan 2005 the lsd was a default option for cars with the chili pack (but there was the option to unspec it)
for a track car i don't think your mileage makes much difference, the engines and gearboxes are strong, and most of these cars were owned by middle aged women for the first 5 years+, so most have not been trashed. And most of the other stuff that wear with mileage like suspension and interior you'd be replacing or stripping out for track use anyway

Both are overpriced, ive just paid £3k for a mint '52 with 64k miles & full BMWSH.
Either of these would be a far more sensible purchase imho:
