Hi folks,

I have just had a friend phone and tell me that one of they friendly loan companies took money out of his bank when he didn't owe them anything. They are going to refund him. I'm thinking that can't be legal, can it? I told him to report them to the FSA. Anything else he should do?

Thanks in advance

Was it Wonga? They've been on Watchdog about doing this to people who hadn't borrowed anything from them...

Well, I thought you were not allowed to name and shame but, it does sound very similar to that. smile What can he do? Report them to FSA. Will anything actually happen to his complaint?

I'm not naming and shaming, I just mentioned that Wonga were on Watchdog for doing this... I'd speak to the FSA and get compensation from them for the inconvenience.

What's the problem, they are refunding him!?

What's his loss?

What if, someone robbed your house and you caught them so, they gave you your stuff back? Would you be happy with that or would you want them punished?

It's an error, they're correcting it.

What's his loss? Has he actually lost anything? If he had some cheques bounce as a result then he might be entitled to claim that, but come on, they didn't exactly bullyram his daughter, did they?

Of course they shouldn't have done it, but what is he after? They're correcting it and presumably said sorry.

Move on.

What is your friend's relationship with the loan company?

Has he borrowed from them in the past.

They are only refunding him because he phoned them up and made a scene.

What if it was a PH member with multiple directorships so, never noticed the missing money until his accountant queried the payment while doing his tax return?

Then clearly he'd ring up and ask for his money back, which he'd get with interest.

If they didn't pay up he'd complain to the FOS.

Really, why does everyone have to be com-pen-sayted when there's a mistake!?!

what if? what if? what if?

FFS let's look at what actual!

He's seen some money go out to firm X. He's called them and they are refunding him.

As far as I can tell from the myriad stories about this both here and on the rest of the web, the company has done nothing against any rules and regs by which it is regulated. Some scumbag has given your mate's account details as the account to pay back their loan, the company cannot possibly check every single detail of every account they deal with and still meet their advertised payment deadline. Some incorrect details slip through the checks they do make. They always refund incorrectly taken payments as soon as they are made aware of them.

Your mate can inform whoever he likes but his situation will not change one iota.

Talk about 1st world problems.

He must have had some previous with them and had a DD mandate in place that neither party cancelled - if no financial loss can be proven he isn''t entitled to compensation.

That analogy is rubbish. THier actions aren't deliberate and there is no negative intention.
It's like saying "What if a murderer cut your wifes tits off and wore them as a mask? Thats exactly the same as what wonga did".

It's a complete inconvenience for him and a waste of his time. Why should he have to fart around chasing up a third party to get money back which should have never been taken in the first place.

I wonder how many people don't notice and then these companies keep the money...

I would be furious if it happened to me and something is clearly wrong with the system that this can even happen in the first place!

Just read back what you've put and how angry you are about something that hasnt even happened to you.
It's utterly mental.
A company makes a mistake that is irritating and people want them reported to teh FSA and slung in prison. Show me a company that has ever existed that hasn't made a mistake and Ill say you have a point.
Jesus. So much fury from people who cant even have a period.

How can a mistake lead to money being taken from the wrong persons bank account?

If a system is in place where money can be taken from someones account without their permission then yes, it should be regulated and there should be fines if a company makes mistakes.

I'm actually more annoyed (not angry) at the people on here thinking it is acceptable that this can even happen.
