Quick question, first child due at the start of March and paternity leave appropriately organised.

However, seems there's a threat of redundancy at my work so I'm looking at other roles. I have a 3 month notice period with my current role, I assume that if I hand in my notice at the start of Feb (for example) my current employer is under no obligation to pay my paternity leave? Is this correct?

Any help or advice would be appreciated, obviously it's not something I want to ask my HR department!

Surely it would be like asking them to honour 2 weeks holiday , after notice had finished?

Paternity is just compassionate (paid) leave isn't it? Though I guess it's enshrined somewhere in employment law!

Well, it would be within my notice period, and it's also protected by law (as you say) but I've no idea whether handing in ones notices negates entitlement?

I'm assuming you are talking about paid paternity as opposed to statutory? Either way you will be entitled to it if it falls within your notice period.

On another note, why on earth would you hand in your notice if redundancy may be imminent? Unless of course you wouldn't be entitled to anything or it's less imminent than three months.....

Congratulations by the way, we're expecting in March too!

Thank you, that's better news than I expected!

As for leaving before redundancy, package is not much better than statutory and I've been there for less than 12 months so any payment would be pretty poor. Might not happen til later in the year but there's a particular opportunity that's turned up which might be very interesting....

Congratulations to you too. It's amazing how ones priorities are re-configured by impending fatherhood!

Sorry, to clarify. My employer offers two weeks fully paid for paternity pay, I've got these scheduled for March.

If I hand in my notice at, say, the end of Feb I'll have to work my notice period which is 3 months, so will be there til end of May. Are they still obliged to give me the two weeks at full pay, or are they entitled just to provide statutory?
