Is this going to be another Tony Martin case?

Doesnt seem like the suspected burglar will die in this case, but is shooting a step too far to defend yourself or your property?

Personally i think not, but i appreciate the dangerous path that takes us down with mistaken identity etc.

hmm
Wonder if the shot man was a traveler?

Wouldn't surprise me if there was more background to this.
e.g. police have been called before but did fk all so man takes law into his own hands

On more detailed reading it seems the burglary and shooting took place in different locations, so i suspect the attempted murder suspect is going to be screwed. Hunting down a burglar to shoot him will be looked upon very poorly by the law.

This is a shame really... I think it would an excellent Olympic sport!

As it should be.

There are very good reasons why we don not allow vigilantes to dish out their own justice.

Name them.

Then explain, by way of reference to the social contract, why the state is adhering to it's side of the bargain....

Hmmm plenty of scope for a Running Man style set to be built in time for June next year...

Interesting, will have to call a friend who lives there to see what the gossip on the jungle drums is.

Reading the article it could be taken that the shooter followed/tracked down the would be burglar or, more likely in my eyes, is that the burglar was shot and was then driven away from the scene of the incident and he and his mate stopped in LS when they realised that he would need medical attention.

LS is about as far down the road from the incident as you might want to get before stopping if you’d just had a gun fired at you and your mate.

1. What is the appropriate level of punishment? With vigilant justice this could range from a good hiding to murder for for theft. IMHO shooting someone for Burglary is not appropriate. In a fair society there needs to be some form of control over the administration of justice.

2. How do we know he shot the right man? Is it just the man he was told did it?
People in a fair society have to be found guilty before justice is administered.

3. What's to stop someone simply going and attacking another person and then claiming they were applying justice for a crime?

In short, vigilantism has absolutley no control over it and as such cannot be relied upon to provide a fair and sound justice system.

From the newspaper and other media reports this one would appear considerably different from the Manchester incident. The offenders were attempting to steal a car according to the report I read. Given that the picture shows the Audi outside in the drive it would tend to rule out a break-in to premises.

The law on defence of self is fairly clear and favours the person being attacked but there are problems with shooting someone who is trying to take a car.

MPs, or rather parliament, cannot 'speak out' on individual cases in a court. Indeed, if a judge does find the man guilty and the government doesn't like it then it is their fault. They make the laws and it would be the law that gets the man convicted. That won't stop them blaming the courts though.

That said, if I was the duty brief and he hadn't said anything to the police after caution then I reckon I could get him off. The law in this country is blanced towards a person threatened.

It seems the homeowner has now been arrested for cultivation of controlled drugs after police found a large cannabis cultivation:

http://www.dailymail.co.uk/news/article-2045999/Malcolm-White-held-attempted-murder-shooting-burglar-home-raid.html

I love this bit:

"Leigh Sinton villager Julian Burton said he spoke to the suspect shortly before he was arrested, and the man claimed they had been walking to a takeaway when a man he described as his brother-in-law was shot. Mr Burton said he spoke with a 'Birmingham accent' and said they had been 'going for a drive' when they 'stopped to get a Chinese but the driver took off because he had no insurance'.

Perhaps they were customers confused about the opening times of the cannbis store?!

It would appear it was not a simple case of two men trying to steal his car. Once drugs are involved all bets are off. Durg deal gone wrong? The waters are very muddy at the moment.
