Bats or Birds?

Tonight, around dusk, there were approx. 6 black flying critters in my garden. They were flying around the bottom of the garden in about a 10 metre diameter circle. They dipped up and down, very quickly, and were silent as they flew... and they're still doing it.

The OH reckons they were birds but I'm not convinced either way. Your thoughts?

Bats for sure, birds will be roosting by dusk.
