Hi all,

Hope you can help and advise me. i have just bought a c43 prem plus 2020 with 13k on the clock. so the logbook has arrived and says 3 previous owners (im the 4th). when i asked the dealership when buying it was told 1 owner from new. If i knew it was 2+ i would never of bought it and carried on my search for a c43.

So it took 10 days for the logbook to come through the post. I instantly contacted Mercedes and told them i was unhappy and would not of bought the car being just over 1 year old with 3 previous owners. They stating that i would of been told about the owners. But i can return the car within 21 days.

The day after i drove the car and the EML started flashing and engine badly misfiring and juddering constantly popping at the exhaust. I pulled up and turned the engine off then restarted it and the light had gone out. i drove it straight to Mercedes with no issues with the car, seemed fine.

i took the keys and log book to return the car as im not happy it was miss sold to me. there response is i have done over 500 mile in the car so i cannot return it and offering me a trade in but will lose money. i explained i drove the car for the first 10 days commuting to work as i normally would, then the log book came with multiple owners. So i raised the issue instantly. How was i aware i could only do 500 mile if i only found out it was miss sold after days of driving.

is there any advise any one could give me regarding this ?

i paid 41k cash and put 5k on finance if that helps

The car has been miss sold to you.

Get onto Ctiizens advice in the morning rather than on here.

They'll tell you what you need to do, and point you to template letters on their website to ensure you get the correct wording.

I'd also put the same letter into the finance company.

The dealer may go quiet on you (Bmw did to me)

If the finance company do not act, give them a deadline to refund you, or you'll raise a complaint with the FCA

This was worked for me with Bmw after 7 months of silence.

Thanks for the reply. I call CAB in the morning.

They offered for me to part ex it in and loose 5k .. im so mad with them.

Unless it has changed I thought you had 30 days / 1000 miles to return any approved Mercedes without having to give a reason.

Read the last paragraph, it is your friend.

Good advice given so far I reckon. Pay a few £s to do an online vehicle check from someone like Carvertical as it might be useful info to throw at the dealer if necessary - some of the car check facilities list the mileage & date the car was previously sold & this might be helpful in getting a full refund.

Also, get the name & email address of the dealer principal from doing some online research (if you haven't done so already) so that you go straight in at the top to get this sorted as some sales managers can be quite difficult to deal with & make sure you use email/recorded delivery when communicating with them.

Under the Mercedes Approved 30 day return policy all you have to do is return the car if for any reason you are not fully satisfied.

No need to make life difficult.

Assuming it was purchased from a Mercedes dealer as an approved car.

Update

So they called me yesterday morning and offered to buy my car back at 5k loss so i refused. i quoted the 30 day exchange on Mercedes website. they informed me they are Mercedes but INHCAPE so they have different terms and conditions, 21 days and maximum of 500 miles.

I therefore phoned the financial ombudsman and my finance company logged complaints. I contacted the Area manager of Mercedes to let him know as they made me a offer of settlement they would take the case on. Within 2 hours i got a call stating i would get a full refund for the vehicle.

Now I’m waiting for the funds to return then start the look for another C43 smile just not with Leicester dealership.

To not complicate any potential comeback from Mercedes you should stop driving the car as well, if you still are.

You were clearly in the right with this and they were trying to avoid their moral and most importantly legal responsibilities.
It's just a shame that you had to take matters further rather than them doing the correct thing right away.

I've had excellent service from a number of Mercedes Main Dealers. The only one I had an issue with was part of the Inchcape Group and I'll never buy a car from that Group again.
