Airpods Pro, replaced twice, and broke again

I bought some Airpod Pro's back in December 2020.
Sometime 2021 the left Airpod starting making a cracking and rattling noise. Apple replaced both Airpods.
Later that year, I had the same problem, but this time on the right Airpod, again, Apple replaced both and this time also replaced the charging case.
Roll forward to now, and the left Airpod is cracking/rattling again. Apple have confirmed that both Airpods have a fault but will not replace them as 1) they're out of warranty and 2) while there's a service replacement out on these, since they were replaced, the date of manufacture doesn't fall within the date range they believe faulty units were produced.
The guy in the Apple store has said this there must be something environment causing the problem.
I'm one of these people like that look after my stuff. I wear these Airpods for Teams meetings, the odd phone call, using my iPad in bed and while I'm out and about with my phone when I'm taking kids to various places.
For me, I can't see how these Airpods are fit for purpose.
Is there anything at all I can do, or do I just suck it up?
I've already ordered a pair of none-Apple replacements, but I'm very much in the Apple ecosystem, and loved my Airpods while they were working.

Consumer law is on your side. I think it’s reasonable to expect expensive earphones to last more than 1-2 years (inc replacements).
Apple handily includes the information on its own website; I would send them (local store manager) a letter quoting the information on their own website, and ask them to replace them. (I’m assuming you bought them directly from Apple in the first place - this matters as otherwise you would have to go back to the retailer you bought them from/are in contract with).

Similar, but different, with my HomePods, purchased 4 originally, 3 replaced under warranty, 1 original still hanging on.
Build quality is not great, repairability is almost zero. Style over substance and built-in obsolescence.
Now I’m out of warranty and with just the one left working, I won’t be buying Apple hardware in future.

I'm a bit of a Fanboy. Multiple Macbook Pro's, Studio Display, Multiple iPad Pros, Ipads, Airpods, Homepods, Airtags etc.Build quality is not great, repairability is almost zero. Style over substance and built-in obsolescence.

Everything has been absolutely spot on, other than these silly Airpods.
I have pro 1’s - first pair were faulty out of the box, every 10 seconds the left one had a sort of whoosh sound build up and end, didn’t do it if NC was off.
Second pair have been brilliant and I use them an awful lot, but after two weeks abroad and lots of sun cream they started playing up. I ripped a tip when cleaning so bought new ones, but noise cancellation wasn’t working, was getting a lot of cracking as if they were moving in my ear.
I turned off NC and decided I’ll live without it , but recently turned it back on and seems to have fixed itself…..
They do seem susceptible to dirt build up and difficult to clean.

In the meantime, while I decide what I'm doing with these Airpods, I've picked up some Soundcore Liberty 4 NC's.
For the price they seem fine. Good noise cancellation.
Sound quality wise. The bass knocks the socks off the Airpods, but then they just don't sound as airy and crisp as the Airpods.

Try Amazon chat, quoting consumer law; I’ve found them to be fairly consumer focused in cases like this in the past, assuming they were the actual seller (ie not a marketplace seller).

Same, my AirPods are by far my least reliable apple product. They did get the most abuse though with being used for running etc. Everything has been absolutely spot on, other than these silly Airpods.
Do you use yours for running or anything where they’re in rougher conditions?
I think despite advertising airpods are suitable for running and sweat resistant etc I’ve never had any brand in ear pods that last that long, I might just get good ones for normal stuff and get cheap ones for running/sports etc
