Hi,

I am having a little trouble with an e-commerce retailer and wondering if anyone knows about this given quite a few of you are in e-commerce, I ordered a product from a company in the EU and it was not in stock, the vendor took money off my credit card straight away *mid-august knowing that in fact the item would not become ready for dispatch until late October.

I seem to remember that vendors are not allowed to take the money until the item is nearing/ready/has been dispatched, is this true?

I raised this with them and they simply refunded the amount, the problem is I have now lost money due to the currency conversion through the refund, I believe they should have reserved the amount not taken it.

Am I mistaken or? any help would be appreciated.

In the UK, I believe you are correct. In practise it doesn't always happen like that.

In the EU (which country?) the regulations may be different. I don't know who would be liable for the difference in refund after currency exchange. Would you be sending some back if it went in your favour?

How much are we talking?

It's between Netherlands and Sweden.

Also it seems they had no intention of delivering the goods within the 30 day statutory contract period, it's only a small amount of Euros but it feels wrong that I face the loss when they did not act correctly.

Is there a 30day statutory supply period?

wrt was the contract in sterling or another currency?

Was your bank account in the same currency?

If your account was in a different currency from that of the contract then it isn’t too much of a surprise that the sterling value refunded was different from that deducted…..

Bought in Euros, paid in Swedish Krona.

No doubt that has caused the loss of funds, but I am questioning the bad process here and am hoping for pointers on that bit, I know why I have lost out, I am more annoyed the retailer got greedy!
