Need help - about TUPE employment transfer ?
Discussion
Hi all, hope you guys can help me here.
I work for a big company and they are going to be closing down the site where I currently work. They recently invested £55 million quid in a new site 40 miles away. This is where we will be going to soon, as all the equipment I work with, has been installed at the new site. The employer has now said that we will be working at the new site, but for a different company (company under contract) and we will no longer be employed by my current employer. Both companies have agreeded that this a TUPE situation. I believe that currently, the new company will honour our existing contract terms (pay/hours etc) but not other things like company pension etc
The questions are, what does the TUPE all mean for me ?Can anybody explain fully where I stand and what options I could investigate, both to improve the existing offer or fight against it. what guarantees should I be looking for ? Anything to watch out for ?
If anybody has any simular experiance, then I'd wellcome your thoughts too. Cheers guys.
Regards John S

John I was tupe'd last year, The new company didn't honour our contracts. They have the "Were bigger that you" "We can do what we like" attitude.
So i have quit, and now
I'm taking them to a tribunal, just waiting for a date.
Not all firms are like the one i was with, your one is probably more law abiding.

TUPE (transfer of undertakings, protection of employment)is designed for such an occurance, to prevent employers selling there business or contracting out services at the detriment of the employee's, when managed proffesionally this legisation works very well, however many companies take on contracted work at very competitive rates with the sole intention of reducing overhead/admin costs by trying to change the contract of the TUPED staff as this is the only way of reducing the cost base and making a profit.
TUPE is really continuous employment, nothing should change, start date, renummeration, holidays, sick pay etc etc, the only current expection being pensions, which currently does not transfer, however this will change effective 6/4/06.
Hope this helps a little
