A mate of mine has recently been offered a job to go over to India to educate the call centre operatives about UK culture and language (hopefully he will tell them about trade unions and force up their hourly rates, but I digress).

However, the agency that put him up for the job originally asked him for £500 if he accepted the job (to which he replied "Feck right off"). Now they are getting him to sign a contract which says that if he leaves within 6 months (possibly 12) that he will pay them £500.

Now I work in recruitment and even to me, this sounds like extortion.

Does anyone know if this contract would stand up in court?

Whooah!
I too work in recruitment and would strongly suspect that your contact is being taken for a ride.
From memory I thought that no recruitment business / agency is permitted to charge ANYTHING for services to candidates. I would recommend that they report them to someone or other - not sure who thought... DTI?

Hmm! Thats what I thought, I told him to take the job (if he wants it) and let them try to take him to court if he cant stick it.

Sounds like they are trying to pass on their liability to the candidate, tossers.

Things like this give us all a bad name.

That's ridiculous - number 1 don't sign it and number 2 did they explain about the £££s before he went for the job?

He might have difficulty in Court if he accepted the terms at outset, I suppose

No Recruitment company based in the UK can charge a candidate for placing said candidate.

Recruitment companies make money by charging the client where the candidate is placed.

Check if the company are members of the REC (Recruitment Employment Confederation). If so contact them and let them know what has happened.

Any Recruitment Business worth its salt will be a member.
