Finally decided to call it a day and have a go working for myself. Going to hand in the notice next week.
My contract says 3 months and I'm prepared to work the full notice for the extra cash. Usually they seem to let people go after a month.
If I say I want to work and they say no go after a month will they have to pay me the 2 months extra ?

True, but it could get a little boring.
The basic ideal of 'gardening leave' is that you are available at thier beck and call so you can't start somewhere else.
However you have an advantage of using that time to sort the paperwork out on your own business ready to start trading as soon as you are out of the 3 months.
Another trick, depending on how friendly your employer is and how desperate they are to loose head count see if they can make you redundant rather than you resign. It needs some special wording but the money becomes tax free!

I don't think companies much care for leavers hanging around - it can lower morale and they might worry you're going to start pinching secrets, inkjet cartridges or whatever. So I'd go for the full holiday - but the redundancy angle is good.
Hoewever that does carry extra legal stuff too I think - like payment depending on how long you've worked there, which your employer might baulk at. Still, I'm sure you'll be able to thrash out an amicable solution, and good luck in your venture.
