Having ordered an item from a website of a well known mail order company, the parcel arrived but unfortunately the item is faulty and I need to send it back for replacement. The Company say that I am responsible for payments to send faulty item back, this seems very unfair to me but is this correct please?

You've probably agreed to it in the terms of sale you clicked yes to without reading. It's common practice.

Indeed the customer is normally responsible via T&C - however in my experience we normally arrange for faulty goods to be collected or just send out replacements.

My advice check their T&C then phone them and assuming you paid by credit card just tell them if they dont arrange collection you will simply charge back the faulty goods via your card - this will normally get them jumping - oh and cancel the order whilst you are at it.

what were the goods BTW

Thanks for reply, that may teach me to wade through the small print , easier not to buy from them again which is what I will have to let em know.

Goods were an outdoor atomic wall clock to fit to my garage apex above the doors. Nice clock but the hands just kept whizzing round and round all the time. I know time flies but this was ridiculas.

I'd just send it back with 'Return to Sender' stamped across the front. I used to do this with Mail Order CD's and DVDs and they never gave me any grief about it.

I've got an 'atomic' clock too. The hands whizz round either when the battery's getting low or it can't find the radio signal. Could these be the problem?

If the goods are damaged on arrival or in the course of resonable use then I'm pretty sure that theres legislation that means the seller is responsible for postage for the return (distnance selling or sale of goods act perhaps?) I'm sure a legal bod will be along soon to clairify, but we were told by our local trading standards officer that we needed to cover costs for return of damaged goods.

Thanks for replies, I decided to the company, explained the situation and they were very NICE and said OK will send you a label and then just send it back. I opted for a replacement. As Simpo says wonder if a signal was'nt being recieved/ Checked with Rugby Atomic whatever it's called and the transmitter was erm transmitting. If replacement won't work I think I will have to find a wind up jobbie.
