L405 Bottom Tailgate failure - not fixed under warranty

Can anyone help who has had experience with the below - the tailgate on my L405 will not close, it attempts to but gets when the bottom tailgate gets to 30% shut it stops and returns back down.

if you lift up the cover to watch the mechanism it has split the metal just next to the metal pulley and looks like the motor is pushing the metal outwards. I think this has caused the metal to split.

my local Landrover garage are saying this is not a warranty item as I must have dropped something on it which I have not, or I have forced the boot shut manually which again I have not done

Anyone had this before as I cant see how this cannot be a warranty issue (its under a Landrover Manufacturers Warranty) and what to do if they will not honour the warranty
