I placed a deposit on a 6 month old r32 on the condition that a few scratches were removed and an alloy was refurbed to the same standard as the originals. I went to pick up on friday and all scratches were still there and they had sprayed the rear alloy on tha same side as the one that needed refurbing as well as the one that needed refurbing but they didnt match up the ones on the other side. I told them I wanted my deposit back (they had already kept me waiting an hour) which they refused to do so I asked to see the guy who telling the salesman that he could refund the deposit. A gentleman then walked towards me staring at me as if he wanted to hit me and sat on at the desk opposite me and just stared at me. I asked him who he was and what his position was to which he replied MD!!!. I told him my complaint and without seeing the car said that I couldnt have my money back. We then went outside and his argument was that it was a 2nd hand car and what did i expect, I tried to explain that I only agreed to buy the car on the proviso that items were taken care of. At one point he said "why dont you take it home and get some t cut and get the scratches out yourself" brilliant customer services eh? Anyway didnt get my money and pointless pursuing this guy as he just didnt have the intelligence to debate with me. So now lies ahead the tedious job of writing letters and talking to customer services.

If it's written into the contract then they have broken the terms. No argument. Tell them so.

If they don't agree go to the small claims court and issue proceedings to recover your deposit. Advise them that you will be claiming compensation for all the grief as well.

It's not a matter of what is "fair and reasonable" as they seem to trying to point out, but what they signed up to in the contract. A failure to comply is very simple to prove.

Nothing. I have email confirmation from the salesman that the scratches would be "taken care of". So although not on the order they can always lie but the salesman will struggle to deny the email.

problem solved then.
Is it a VAG dealer? If so, get in touch with the UK customer services division by phone.
Tell them that you are still looking at buying a nearly new R32, but feel hard done by losing your deposit. Let them know that you have suffered much stress, and as such are considering purchasing from a different manufacturer(BMW etc). This should get you your deposit back, and may even get you some form of compensation.

Always write conditions into the sale agreement. Bitter experience speaking.

Without naming and shaming, where are you to the nearest 10 miles.

I place alot of business with VW, so may be worth a word if you're in my neck of the woods so to speak!

I had a similar experience when buying the S3 and it took about 3 or 4 trips back to the dealer before they finally did everything they agreed to. Write to VW UK and a call from them to the dealer principal should sort things out (it did for me with Audi). Good luck!

Thanks for the replies. I am based around junction 28 of the M1 but its not the local dealer to me. Im not worried about proving that I had an agreement regarding the scratches being done as the sales guy quite clearly shows his understanding of the situation when he emails me. What concerns me is the way they reacted without even checking any paper work, it shows an element of recklessness and an uncontrolled reaction. If you want to tell someone to foff in a professional capacity you tend to make sure all the angles are covered. This guy had no thought process just an agressive reaction. I am amazed that he is MD. That reminds me must go onto Companies house website to check he is a 288 director, perhaps he got confused and is really Main dooropener!

And he's the MD? Are you sure he was not out the asylum for a day's recreation?

He'd have been lucky if he kept all his teeth in his skull if he spoke to me like that

Said from the safety of an isolated PC miles from anyone else

Yes I did have to bite my tongue. Problem is if you show any violence you have lost immediatley. Still it would of been worth £500 then.

Is this a VAG main dealer? Stick to your guns!

I bought my S3 from an independent. They did my list of tidy up's perfectly, on time with a smile.

I imagine the threat of legal action/contacting uk hq/local and national press would make them back down and give you the £500 back. Its not worth it to them.
