Mk3 Golf Exhaust "brace"

Hi All,
I need a new centre section to my exhaust (93 1.8CL) I popped into a local place as I wasn't sure what section was blowing (Only slightly but its underneath the car and annoying me)
Anyway they had a centre section in stock so I decided to get them to fit it for me. Unfortuantly in their haste to get the nuts off the brace that runs across the width of the car is a that is designed to "catch" the exhaust should it break (Stops it falling off apparently - according to VW) they broke all the bolts!
According to VW it won't be a problem and it doesn't affect the structure of the car (eg. If I jack up one corner I won't bend the chassis) but is there any requirement to have this brace here for the MOT? Or can I leave it off?
I need to get the smaller brace off which is towards the front of the car so that I can get the centre section of exhaust out. (Didn't fancy the garage having a go at that one with an air gun!)
