MSV is the biggest owner of motorsport tracks in the UK and in my experience they run them very well.

That said, I think Condition 3 of their Camera Use T&Cs absolutely stinks and for no good reason.

Here are their Conditions >

1. In consideration for MSV allowing me to use an on-board camera (“the
equipment”), I agree to indemnify MSV, its affiliates and employees, from and against all actions, claims, costs, expenses and demands howsoever arising in respect of death, injury, loss or damage to the person or property of any person arising as a result of my use of the equipment.

2. The equipment must be fitted in advance of scrutineering. Notwithstanding the foregoing, safe attachment of the equipment is my responsibility. I will only use bolt-on mounting systems designed specifically for the purpose, and not suction or other temporary mountings.

3. I declare that any material filmed is for personal use only and is not for broadcast (whether for commercial reasons or otherwise) on any public transmission media anywhere in the world (including but not limited to internet, terrestrial, cable or satellite), and I agree to pay MotorSport Vision the sum of £25,000 if any material filmed should appear on such media.

Why on earth 3? Why shouldn't people be able to share vids (as they do all the time already on channels like YouTube, a lot of which is material @ MSV owned tracks) via the Internet; there's no commerciality involved/profit being sought: MSV are losing nothing so why the £25K threat or rather promise! Sharing videos is especially useful/purposeful/pertinent when it comes to the genuinely interested/involved; for example, the ROC Forum which is a Member Only Area, so a no go area for any sad case nerds just looking for every 'crash & burn' vid they can find.

I know that several faces @ MSV track this Forum ........... so no meaningful reply from them is not really on.

C'mon MSV, the year is 2010, the FOI Act is a few years old now - time to change 3. to something like >

3. Well, annoying as it is, I doubt they will change it, as they chose to put it in.

I can't quite fathom the rationale though.

The main reason (we believe) is for insurance reasons; insurers really don't like it if accidents they're paying out for appear online.

Well, that's very interesting OR. Obviously MSV are quite serious about it as 25k is quite a deterrent. I wonder if they've gone after anyone yet?

There can't be that many insured crashes on race tracks. I wonder why the ins co's are so sensitive? What has it to do with MSV?

So many questions!

May I refer my learned friend to the case of Everyone Completely Ignoring It vs MSV and to the similar test case, A Bit of Common Sense vs MSV.

The fact is, if you produce a world syndicated mini-tv-series, JP (the one with the circuits and helicopters) is going to want a few quid from you.

If, however, you're only aiming to show your mates, and the world, how crap you are, I reckon you'll be OK.
