oil capacity

after successfully replacing the head gaskets,i need to change the oil and filter.i can get a filter locally and have bought 3x 4L mobil 1. the service manual states the engine capacity (with filter)is 9.5L,but when i have looked back at the cars history,steve Kingshott (a previous owner)had the oil changed three times at a main dealer and only 8L of oil was used each time .so is the manual incorrect or does 1.5L of old oil stay in the engine?

the manual is correct, no 1.5 litres doesnt stay in the engine
