Hello all, seeking some advice please. My partner rides a scooter to work sometimes (in a small rural market town). She has been parking it in a 2-hour maximum stay bay, slotted between cars. Never had an issue until she got a ticket last week for exceeding the time by 30 minutes.

I contested it under the ‘it’s a motorcycle, restrictions should not apply’ banner, but they have rejected my appeal as they say the time limit applies to all vehicles.

This doesn’t seem right to me, as she could have popped it on the pavement without causing obstruction and to my (admittedly maybe out of date knowledge) bikes are not subject to restrictions (outside of Westminster).

All advice welcome!

I can only speak for London. The boroughs are all different.

Wandsworth you can park in car bays and not have any restriction if a motorbike but other boroughs have stricter rules.

Slightly different but maybe related thought. Wasn't there a case a couple of years ago where someone parked two Smart Cars in a single bay and bough a single ticket? As I remember (and I may just be making this up) it went to court and it was decided that as long as the bay was paid for, the number of vehicles in it was irrelevant.

If that is the case, and it may be worth a Google, then as long as the cars in the bays paid their tickets and they changed within the 2 hour interval, then, you may be able to argue that the bike should be OK.

Rule 244 has all the approaite MUST and should statements to show that pavement parking is illegal in London, not in rural market towns.

I used to think it was illegal everywhere too! paperbag

If you have a careful look at the parking sign/terms and conditions it may help answer your question as it may only refer to cars etc - worth a look

The answer is... the rules for parking depend on the local council. Unfortunately, that means every time you park somewhere, if there is not sign specifically mentioning bikes, then you have to go on the council website and look it up. Some you can park anywhere, some you can park only in bike bays, some you can park in shared use bays (resident and pay) but not in resident only bays.

No easy answer.

One of the reasons bikes are usually excepted from things like pay and display is that it is impossible to display a ticket securely.

That said I wouldn’t park in a car space in such circumstances.
