1999/2005 3 Series rear chassis design fault

i have a 328Ci BMW which was registered in 1999. it is currently in a BMW workshop due to the chassis giving away around the rear axle mounts. they have not corroded or rusted. i get the impression from the engineers that this is not the first time they have come across it.

has anyone had this issue?

has anyone been able to get BMW to pay out for this?

are there any trade bodys to which i can speak to that will assist me in making a claim if necessary?

would really appreciate any advise.
