BMW 730D F01 LCI Handbrake Failure

Hi all,
I have a dilemma with my F01, in the mornings after standing through the night, or after leaving it for long time. It shows a handbrake failure on the dash and yellow handbrake light.
However, after driving it and than restarting the car it goes away. The actuator works fine at that point engaging and disengaging the handbrake.
Sounds fine as well no grinding noise so no teeth are broken on the actuator.
I scanned the codes and it comes up as button faulty and handbrake failure. I just don't seem to understand how the button can be faulty as after driving the car it works fine.
Anyone else encountered this issue or could shed some light on it?
