M3 gearbox problems?

My friend has just purchased a 2003 M3 with the manual gearbox from a main dealer with 13,000 miles.The gearbox is incredibly notchy and reluctant to engage any gear unless he is gunning it and then it seems fine.Anyone else had a similar problem or know of anything to look for? He took it to his local dealer who agreed it wasn't right, but the supplying dealer wouldn't authorize the repair without seeing it themselves and surprise surprise, despite the sales manager agreeing at first that it appeared "not 100%" they now say there is nothing wrong.Driver error can be discounted, so any ideas?

2nd will be awkward when cold and it'll probably always be slightly notchy if mine is anything to go by. Once warmed up though you should be able to get gears without a struggle.

I'd tell your friend to take it back to the dealer asap. It sounds like the clutch may be dragging or the linkage isn't right to me.
