I put a deposit on a tuscan at fernhurst last year but had to leave the country and was unable to follow through on the purchase. The refused to return the deposit after my return and i was unable to then buy another car.So i have a deposit which is just sitting there. Is there anyone who would like to buy the deposit off me for a discount. the deposit is £2000

They're perfectly correct legally to keep your deposit - they could insist that you purchase the Tuscan as you have entered into a binding contract with them - they don't have to let someone else take over your deposit either as the contract is between them and you personally, no-one else.

Firstly i am not nigerian but thanks for the dry humour, secondly i am aware of the facts raised by jigs but i am sure that if you were in my situation you would try and find some way to recoup some of the loss.

Can't you give the dealer some sob story, and play the sympathy card, they may fall for it, and come to some "arrangement" with you, perhaps refunding 75% of it......Worth a try imo....

Silly season now , you put the deposit down on a new TVR, Fernhurst are no longer main dealers so deposit cannot be used against a new TVR via them , should it not therefore be refundable as they cannot meet their side of the transaction.
Failing that, could it not now be transfered to another main dealer who can purchase new TVR's giving you a bit more flexibilty on being able to trade your deposit someone else .
Any dealer or legal types out there care to comment please, with a bit more actual knowledge than I'm currently spouting off , All IMHO as usual.

thanks harry you are definetly going in the right direction.

I'll never buy another car through a dealer (they sold the car that i wanted straight away so why keep my deposit ???????)

Ah you definately need a leagal type to answer then as if they have not lost out i.e. they sold the car anyway. They do not AFAIK have the right to withhold your deposit now.
It's to secure a purchase and off set any losses should you not go through with the purchase IMHO. Not to make extra profit for them, which is the line I would be taking.

Dad says very valid point and one which may well be worth persuing how ever why has the deposit been on the table for so long when the deposit was placed it should have triggerd an actual order at the factory? Unless TVR don`t work the same way as all other dealers he`s worked for.

Well thats the thing about deposits. They hold the car in return for some of the payment up front. You change your mind, they keep the money.
