I bought a car quite recently as i am sure a lot of you are aware. I have since found out that the car is not a red rose car. I bought the privately and am extremely pissed off. I specifically wanted a red rose car and i feel that i have been totally decieved. What should i do???

Get a marker pen out and scrawl red rose all over the engine.

Seriously tho, thats false advertising isnt it???

If it makes you feel any better the most powerful Tuscan I have seen on the rolling road was a standard engined car...

I spoke to tvr, they gave build sheet info.

If the car was described as something it wasn't, and you have proof of that, then you are entitled to either your money back, or keep the car and compensation or in some cases both.

Specifically the Misrepresentation Act 1967 applies to both private sellers and businesses.

Firstly - decide what you want, do you want to return the car and get your money back, or just a heavy discount off the car (I'm lead to believe there is a red rose upgrade - if so a fair compensation claim would be the cost of that upgrade)? Ensure that you get all your evidence together (of the original advert/descrptions, and the factory report).

Second thing to do is to contact the seller, present your evidence (which it sounds you have), and ask for what you want. Explain that he has breached the appropiate act, and that you will take the matter further if he/she does not provide what you want.

If you don't get any further, then in such a clear case as this, you should consider civil legal action. Your local trading standards or CAB office (www.citizensadvice.org.uk/) will be able to advise you how to do this.

Could you not have got the report from TVR before buying the car? What #I mean is, did you try and TVR couldn't help, or did you not try until you had the car?

Just so future buyers know if TVR can help them out BEFORE they part with the readies

As for your case, the advise below souds good, you seem to have a strong case

thanks j for that good advice. I bought the vehicle a couple of months ago , will this be a prob' do you think?

No - normally that's only a problem if the car was described as "immaculate" or similar and it turned out it wasn't - you need to claim on that within a very short amount of time otherwise it's hard to prove that you didn't shagg it yourself.

In your case it's a specification missing (bit like saying it has sat nav and it doesn't) and so is cut and dry.

Wasn't it the case that the car was described as having Red Rose brakes and suspension rather than being a 'Red Rose Tuscan'?

Did it have the uprated brakes/suspension but standard engine?

I'll have a look on my receipt, is show the cost for the RR conversion, I think it’s about £3558+vat £4180 ish.

As Ted stated, have a look at the original advert. I've got to admit that I bought one private and it was only because the guy had the original receipt from the guy that I was sure it was a RR. I did speak to Hannah at TVR and pay the £30 +vat for the original Spec sheet to double check though.

I know someone who bought a tuscan through a main dealer (name with-held to protect the guilty) .. mid way through the order process the S was introduced and the customer was given the opportunity to upgrade his spec to an S. He thought this meant he would actually be getting an S, and he paid the S pricem so I'm led to believe. Now the first cars never came with an S boot badge cos there weren't any at the time (first five or ten cars or something) .. now he's gone back to the dealer wanting to trade for another TVR only to be told his car isn't an S at all, is worth literally thousands less than he thought it should be and is now in battle trying to prove the true identity of his car. I've only got the info the customer has given me so haven't heard all sides of the story and there may be more to it than first meets the eye (or ear), but it would seem that if you had an early tuscan S then get proof now that it IS recognised as an S and not a regular tuscan upgraded to S spec, which apprently makes it worth alot less .... a call to your dealer and the factory might be all that's needed to put your mind at rest.

Had a similar story recently when purchasing my late 2000 Tuscan from main dealer. What he told me was that the standard spec was increased about Sept 2000 to what had previously been the optional red rose upgrade.
